NTC releases guidelines on PH Internet domain

THE National Telecommunications Commission (NTC) on Friday released the implementing rules and guidelines on the administration of the PH country code top level domain (ccTLD).

Commission on Information and Communications Technology Chair Virgilio Peña, a member of technical working committee tasked to review the implementing rules and regulations, also said the guidelines would be published the same day at the UP Diliman Law Center.

In remarks at the Synergy press briefing over the weekend, Pena said he had initiated talks with officials of DotPH Inc., the current administrator and sole registar. The company, which has operated unregulated until now, has consistently opposed the guidelines.

Since 1989, Joel Disini has served as the administrator of the domain. In 1999, his company DotPH became the sole, official domain registry of the Philippines, registering and selling domain names with the PH country code.

The guidelines bring the administrator’s operations under official scrutiny and regulation for the first time. They also spell out the legal and technical qualifications that the administrator must meet.

Significantly, the guidelines call for a separation of the registry—the database of Internet names and numbers—and the registrar, the entity that markets these addresses.

The guidelines give DotPH three months to choose to be the administrator or a registrar, a commercial entity that sells domain names and addresses. It may no longer do both.

In an earlier interview with TechTimes, Peña said DotPH would have no choice but to comply with the guidelines. If it doesn’t abide by the guidelines, Peña added, the next step would be for the government to ask the Internet Corp of Assigned Names and Numbers (ICANN) to delegate a new administrator, a process called redelegation.

Among others, the guidelines state:

• That the PH domain name is a public resource.

• That the administrator of the PH domain is the trustee of the ccTLD for the Philippines and is accountable to the local Internet community. As a trustee, the administrator must be able to carry out its responsibilities in an equitable, just, honest and competent way.

• That the local Internet community must be assured of efficient, stable, fair and transparent administration of the PH domain, consistent with the policy to uphold and maintain consumer rights
